ANJANA MISHRA ORAL ORDER 30-08-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 147/148/149/323/427/379 and 307 of the Indian Penal Code. Learned counsel for the petitioner submits that for a complaint case filed in the year 2005, cognizance has been taken for the offence in the year 2016 and as such, the petitioner apprehends his arrest. It is submitted that no case under Section 307 of the Indian Penal Code is made out as no injuries purported to have been inflicted, have been found.

Considering the nature of allegations made and that the petitioner has come under the net of the prosecution after lapse of eleven years and also because the petitioner is having one other Complaint Case lodged by the same informant in the year 2015,

Patna High Court Cr.Misc. No.32876 of 2016 (2) dt.30-08-2016 P2/2 let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Korha P.S. Case No. 119/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
