The petitioner apprehends his arrest in Buxar Town P.S. Case No. 04 of 2016, registered for the offences punishable under Sections 363 and 365 of the Indian Penal Code. The informant alleged that her husband went along with owner and driver of the truck, but he did not return. It is submitted that the petitioner has falsely been implicated in the case. The petitioner is the driver of the truck and the husband of the informant was asked to go to Delhi as a cleaner of the truck but he fled away somewhere else. The informant suspected that the petitioner and others killed her husband. The owner of the truck, namely Gokul Tiwari has already been enlarged on anticipatory bail vide order passed in Cr. Misc. no.

Patna High Court Cr.Misc. No.30181 of 2016 (2) dt.09-09-2016 2/2 5975 of 2016. The case of the petitioner stands on the similar footing.

Considering the facts aforesaid and the fact that on mere suspicion the name of the petitioner figured in the case and similarly situated co-accused has already been granted anticipatory bail, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Buxar Town P.S. Case No. 04 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
