The petitioner apprehends her arrest in a criminal prosecution registered under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.
Taking into consideration the fact that the petitioner is specifically named in the FIR vide Annexure-2 as an accused with an allegation that she has used forged and fabricated documents for obtaining employment on the post of teacher and also taking into consideration the fact that the petitioner is accused in some other criminal case of similar nature, as has been mentioned in paragraph 3 of the bail application, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of anticipatory bail. Accordingly, her prayer for anticipatory bail in connection with Pratapganj P.S. Case No.17 of 2015 pending in the court of learned Judicial Magistrate-1st Class, Supaul is rejected.
If the petitioner surrenders in the court below within a period of four weeks from today and applies for regular bail,
Patna High Court Cr.Misc. No.33417 of 2016 (2) dt.10-08-2016 then the same shall be considered on its own merits without being prejudiced by the present order.
