JUSTICE ARVIND SRIVASTAVA ORAL ORDER 10-11-2017 Heard learned counsels for the petitioners and the State. Petitioners apprehend arrest in connection with Birpur P.S. Case No. 109 of 2017 registered for the offence punishable under sections 302/120B of the Indian Penal Code. Learned counsel appearing for the petitioners submits that the present first information report has been lodged after delay of about two and half months without any explanation. In this connection, earlier a U.D. case was also lodged. During investigation, nothing has come to suggest complicity of these petitioner in the alleged crime. Rather, witnesses have stated that the deceased committed suicide. Petitioners have no criminal antecedent.

No.43936 of 2017(4) dt.10-11-2017 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Birpur, Supaul in connection with Birpur P.S. Case No. 109 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
