2. The petitioner seeks regular bail in connection with Barahiya P.S. Case No. 288 of 2024, registered for the offence under Section 70(1) of the B.N.S., 2023 and section 67(A) of the I.T. Act.

3. As per prosecution case, a video was circulating in which some persons have seen committing rape with the victim. The petitioner is identified one person who has committed rape. The petitioner is in jail since 22.11.2024.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. He further submits that charge-sheet has been submitted but there is no victim till date and cognizance has not been taken in the case.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the fact that petitioner has been identified as one of the perpetrator to the crime, I am not inclined to grant bail to the petitioner.

7. Accordingly, this application for regular bail is dismissed.

8. If the trial is delayed by the prosecution, the petitioner may renew his prayer for bail. The court below is directed to proceed in the case and pass further order on the charge-sheet, if no cognizance has been taken. (Sandeep Kumar, J) Ranjeet/- U T
