This is a petition for grant of anticipatory bail for offence under Sections 341, 323, 379, 504, 506, 308 and 34 of the Indian Penal Code.

Petitioner, Bishunu Sharma @ Bishun Sharma, was allegedly seen in a compromising position with co-accused, Gyanti Devi, by the informant and for that occurrence a subsequent occurrence of assault took place wherein petitioner Bishunu Sharma allegedly caused injury at the head of the informant with rod.

The petitioner, Bishunu Sharma @ Bishun Sharma, had knowledge that his act might cause death, I am not inclined to grant anticipatory bail to the petitioner.

Since, prayer for anticipatory bail on behalf of petitioner, Bishunu Sharma @ Bishun Sharma, is refused. Other petitioners, namely, Amit Sharma, Shiv Kumar

Case No. 263 of 2017 to the satisfaction of the Chief Judicial Magistrate, Saharsa, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
