The petitioner is apprehending his arrest in connection with Barun P.S.Case No. 240 of 2013 registered under Sections 302 and 201/34 of the Indian Penal Code.
Earlier case diary in the present case was called for, which has since been received.
Learned counsel for the petitioner submits that save and except the statement of one Usha Sharma, who has named this petitioner, there is no other cogent material on record so as to connect the petitioner in the present case.
Learned counsel for the State after perusing the case diary submits that it is only out of suspicion that the petitioner has
Patna High Court Cr.Misc. No.17770 of 2015 (4) dt.12-10-2015 been named in connection with this case.
Considering the aforementioned facts and circumstances and that save and except two other cases against him in which he has been extended the privilege of regular bail there is no further material against the petitioner, let the petitioner, above named, in the event of his arrest/surrender in the court below within period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each in connection with Barun P.S.Case No. 240 of 2013, corresponding to G.R.No. 2530 of 2013, to the satisfaction of the Chief Judicial Magistrate, Aurangabad, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
