JUSTICE SANJAY KUMAR ORAL ORDER 05-04-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend arrest in connection with Bihariganj Police Station Case No. 250 of 2017 registered for the offences under sections 323, 341, 307, 354(A), 379, 504, 506/34 of the Indian Penal Code.

It has been submitted that the petitioners are cousin of the husband of informant and they are at litigating terms for ancestral land. Allegation of assault is omnibus and no offence as alleged is made out. None of the family members of the informant sustained injury and the informant has not been treated by any doctor. The petitioner and informant are agnates and there is dispute for partition of their ancestral land. Considering the facts and circumstances of the case,

No.14784 of 2018 (2) dt.05-04-2018 2/2 the prayer of anticipatory bail is allowed and the above named petitioners in the event of arrest or surrender before the learned court below within six weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Abhimanyu Kumar, Judicial Magistrate 1st Class, Udakishunganj, Madhepura, in connection with Bihariganj Police Station Case No. 250 of 2017, subject to conditions as laid down under section 438(2) Cr.P.C.. Further condition is that (1)one of the bailors of the petitioners shall be local person having sufficient immovable property within the jurisdiction of the concerned Court. (2) The petitioners will not induce any witness or tamper with the evidence. (3) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.
