The petitioner apprehends his arrest in Sohsarai P.S. Case No. 78/2013, registered for the offences punishable under Section 420, 409 and other sections of the Indian Penal Code. The complainant/informant alleged that he came across with one Abu Obaida who introduced himself to be an agent of Punj Loyd Construction Company. He persuaded him to work and on such he handed over the agreement for construction work. The informant invested Rs. Twenty three lacs, but when he demanded money, Abu Obaida did not pay the same and disclosed that the agreement is forged one.
It is submitted that petitioner had no talk with the
Patna High Court Cr.Misc. No.31022 of 2015 (3) dt.12-10-2015 2/2 informant to work for his company. Abu Obaida is the person who persuaded the informant to work. He has already been granted anticipatory bail.
Learned counsel for the informant however, opposed the prayer for anticipatory bail.
Nowhere it appears from the complaint petition that the petitioner ever asked the complainant to work for his company. Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Sohsarai P.S. Case No. 78/2013, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
