The petitioner seeks pre-arrest bail in connection with Narhat P.S. Case no. 136 of 2015 registered under sections 341, 323 and 307 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the petitioner being an extremely poor man has been implicated in this case only on the basis of hearsay statement of one Manti Devi. The informant is not a witness to the occurrence and the alleged victim was never ever treated by any doctor and there is no material to support the allegation that the petitioner ever intended to kill the minor son of the informant. Learned counsel for the State has opposed the

Patna High Court Cr.Misc. No.29041 of 2016 (2) dt.26-07-2016 application for grant of pre-arrest bail to the petitioner. Regard being had to the nature of allegation made in the first information report, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, Nawadah subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
