JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 14-09-2020 Heard Mr. Ranjeet Kumar learned counsel for the petitioner and Ms. Dipika Sharma for the State. The petitioner is aggrieved by the notification dated 14.2.2020 issued by the Joint Secretary, PHED, Government of Bihar, Patna whereby the petitioner has been suspended in purported exercise of under Rule 9(1) (A) of the Bihar Government Servant (Classification, Control and Appeal) Rules, 2005.

Mr. Ranjeet Kumar, learned counsel for the petitioner

Patna High Court CWJC No.7114 of 2020(3) dt.14-09-2020 2/2 would submit that the respondents have put the petitioner under suspension in contemplation of the departmental proceeding but unfortunately till date the respondents have not initiated departmental proceeding as Prapatra Ka has not been served upon the petitioner as yet.

Considering the aforesaid, the writ petition is disposed of with a direction to the respondents to conclude the departmental proceeding in all respect within a period of four months from the date of receipt/production of a copy of this order failing which not only the order of suspension but the entire departmental proceeding shall come to an end after expiry of four months.
