ANJANA MISHRA ORAL ORDER 02-05-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Simari Bakhatiyarpur P.S. Case No.307 of 2014 for allegedly having committed the offence under Sections 364 and 366A/34 of the Indian Penal Code. Case diary in the present case was called for, which has since been received.
Learned counsel for the petitioner submits that the main accusation is against one Abhisekh alias Rahul Yadav and not against the petitioner. The only allegation levelled against the petitioner is that while the victim had been kept confined,
Patna High Court Cr.Misc. No.50574 of 2015 (4) dt.02-05-2016 2/2 the names of the petitioner and others were being taken. It is further submitted that the victim girl had stated that she had gone on her own sweet-will and married with one Abhisekh and is living with him.
Considering the aforementioned submissions and that the petitioner has no criminal antecedents as reiterated in paragraph 3 of the petition, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa, in connection with Simari Bakhatiyarpur P.S. Case No.307 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
