The petitioner seeks pre-arrest bail in connection with Imadpur P.S. Case No. 33 of 2015 registered under Sections 307 and 504 of the Indian Penal Code. It is contended that the even if the allegations made in the FIR are taken to be true, the same would not attract the ingredient of the offence punishable under Section 307 of the Indian Penal Code. Referring to the injury report of the informant as contained in Annexure-2 to the present application, it has been submitted that the injuries sustained by the informant are simple and superficial in nature.

No.42462 of 2015 (2) dt.12-10-2015 2 / 2 Regard being had to be nature of allegation, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur in connection with Imadpur P.S. Case No. 33 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C.
