The petitioner seeks bail in a case registered under Sections 302, 201/34 of the Indian Penal Code. The prosecution case, in brief, is that owing to money dispute, the accused-petitioner is said to have committed murder of his brother Nippu Ram by slitting his neck and dead body of the deceased was thrown in the river Gandak.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 24-06-2019. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. The informant is not an eye

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R. The witness, examined in paragraph-22 of the case diary, is an eye witness. As per the statement of that eye witness, the petitioner is the assailant. Considering the facts and circumstances, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner in connection with Sessions Trial No. 60 of 2018 arising out of Maker P.S. Case No. 75 of 2018 is rejected.

The trial court is directed to take all possible steps to expedite the trial and conclude the same, preferably within a period of nine months from the date of receipt/production of copy of this order.
