2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 25 (1-AA), 25 (1-B), 25(1-B)a, 26/35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is in custody since 03.20.2026 and the informant alleges that he got secret information that Vikas and Punanand Mistry @ Badhai are manufacturing gun in their shop, accordingly, the informant reached the place of occurrence and Vikas was arrested, who disclosed the name of Punanad Mistry @ Badhai, who fled away, further, on search of shop, many half made country-made pistol along with part of pistol and live cartridge were seized.

4. Learned counsel submits that petitioner is not named in

Patna High Court CR. MISC. No.24359 of 2026(2) dt.12-05-2026 2/2 the F.I.R., and his named transpired based on confessional statement of Vikas Kumar, in police custody which does not have any evidentiary value, it is next submitted that petitioner has no relation or concern with Vikas and his family, it is next submitted that Nagehwar Sharma had approached this Court seeking anticipatory bail by filing Cr. Misc. No.53341 of 2025 and the same came to be allowed by an order dated 18.08.2025, it is further submitted that name of Nageshwar Sharma is uncle of Vikas and his name transpired in the confessional statement of Vikas in police custody which has no evidentiary value, it is further submitted that if privilege of regular bail is granted, the petitioner will not abscond rather will cooperate in trial to prove his innocence.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Saharsa, in connection with Darhar P.S. Case No. 11 of 2025.
