The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 409 and 188/34 of the Indian Penal Code.

As per the prosecution case, petitioner along with others misappropriated government money during execution of government scheme Nali-Gali Yojana under seven Nishchay scheme.

It is submitted that petitioner has been falsely implicated in this case. The Junior Engineer after institution of FIR made physical enquiry/verification and submitted report to the Block Development Officer, Silao about the physical status of the work done in the concerned ward in which he found and

Patna High Court CR. MISC. No.24734 of 2022(2) dt.12-09-2022 2/2 reported that all grievances has been redressed and the water supply has been functioning properly. It is next submitted that there is no deficiency in the work and it is not a case either of cheating or of criminal misappropriation of money. Moreover, Similarly situated co-accused has been granted bail by this Court vide order dated 09.07.2020 passed in Cr. Misc. No. 12591 of 2020. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda in connection with Nalanda P.S. Case No. 164 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
