1. Heard learned counsel for the petitioner and learned A.P.P. for the State Mr. Ravindra Kumar.

2. The petitioners seek regular bail in connection with Katra P.S. Case No.295/2023 (Jajuar O.P.) registered for the offences under sections 147, 148, 149, 341, 323, 324, 325, 326, 307, 447, 448, 452, 120(B) of the I.P.C. & Sections 25(1-B), a, 27 and 35 of the Arms Act.

3. The learned counsel for the petitioners submits that petitioner no.1 has antecedent of 3 cases and petitioner no.2 is a person with clean antecedent. It is further submitted that petitioner no.1 is alleged to have fired causing gunshot injury on the brother of the petitioner and as far as petitioner no.2 is

Patna High Court CR. MISC. No.27209 of 2024(3) dt.28-06-2024 2/3 concerned, he is alleged to have assaulted the family members. It is next submitted that petitioners are in custody since 03.11.2023. It is also submitted that as far as petitioner no.2 is alleged, there is no allegation against him of causing firearm injury to the injured.

4. Learned A.P.P. Mr. Ravindra Kumar opposes the prayer of regular bail application of the petitioners and submits that from perusal of the order impugned, it would manifest that the same records that at para-130 and 131 of the case diary, it has come that the injured suffered multiple gunshot injury.

5. At this stage, the learned counsel for the petitioners that even presuming what has been alleged is true without admitting then allegation of firing is against petitioner no.1.

6. Considering the submissions, the petitioner no.2, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class Court No.7, Muzaffarpur (East), in connection with Katra P.S. Case No.295/2023 (Jajuar O.P.).

7. Further, one of the bailors of the petitioner no.2 shall be his father, namely, Egne Mandal.

8. The court is not inclined to release the petitioner

9. Accordingly, the regular bail application is allowed partly.
