The petitioner being the husband of the complainant is apprehending her arrest in a complaint case wherein processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 498A, 406/34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.

The basic accusation is of torture for nonfulfillment of the dowry demand. The matter was referred to the Mediation

Patna High Court Cr.Misc. No.10295 of 2015 (5) dt.12-10-2015 2/2 Centre on the joint prayer of the parties. The report of the Mediator dated 06.10.2015 at Flag 'M' reflects that the issue could not be resolved through the process of mediation. The petitioner and the complainant are present in the Court.

The complainant is ready to resume the conjugal life but the petitioner is adamant not to accept the offer of the complainant.

In the circumstances, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of eight weeks from today in connection with Complaint Case No. 3087 of 2013 pending in the court of learned Subdivisional Judicial Magistrate, Siwan. With the aforesaid observation, this application is disposed of.
