JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and the State. Petitioners are apprehending arrest in connection with Matihani P.S. Case No. 102 of 2017 for an offence under sections 341, 323, 307, 379, 447 and 504/34 of the Indian Penal Code.

Counsel for the petitioners submits that in the instant case the allegation of assault by iron rod is against co-accused Vinesh Kumar.

So far these petitioners are concerned against them there is allegation of assault by fist and slap. Considering the fact that the main assailant in the instant case is Vinesh Kumar and not the petitioners, the court is

Patna High Court Cr.Misc. No.41001 of 2017 (3) dt.17-10-2017 2/2 inclined to grant bail to the petitioners named above, in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-III, Begusarai, in connection with Matihani P.S. Case No. 102 of 2017 subject to the condition as laid down under section 438(2) of the Cr.P.C. with further condition that the petitioner will cooperate in the investigation and will not, in any manner, influence the evidence or the witnesses.
