The writ application has been filed for a direction; upon the respondents to withdraw the amount in the sum of Rs. , 3,28,555/- payable to the petitioner but by mistake credited in the account of o some other person.
A counter affidavit has been filed on behalf the respondent no.3.
Counsel for the State, drawing attention of the Court to the averments made in paragraph nos. 4 and 5 of the counter affidavit submits that on detection of mistake the said
Patna High Court CWJC No.6573 of 2014 (2) dt.30-01-2016 2/2 amount was withdrawn from the account of other person and paid to the petitioner through cheque dated 10.6.2014 which was received by the petitioner himself. On the strength of the aforesaid pleadings it has rightly been submitted by the State counsel that the application has become infructuous as the grievance of the petitioner has been redressed.
The application is dismissed.
