The petitioner seeks regular bail in connection with Ballia Police Station Case No. 06 of 2020, registered for the offences punishable under Sections 366-A/34 of the Indian Penal Code.
The allegation against the petitioner is that the petitioner abducted the minor daughter of the informant. Learned Counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged. He further submits that the date of occurrence is 12.10.2019, whereas the First Information Report has been lodged after a considerable delay on 08.01.2020. He, referring to the statement
Patna High Court CR. MISC. No.22979 of 2020(2) dt.07-09-2020 2/2 of the victim girl, recorded under Section 164 of the Code of Criminal Procedure, 1973 (Annexure-2), submits that in her statement, the victim girl has not disclosed anything against the petitioner and has categorically stated that she has performed marriage with the petitioner in a temple.
After having heard learned Counsel for the parties and taking into consideration the fact that in her statement, recorded under Section 164 of the Code of Criminal Procedure, 1973, the victim girl has not stated anything against the petitioner, I am inclined to grant regular bail to the petitioner. This application is allowed.
Accordingly, let the petitioner, above named, be released on bail, upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Ballia Police Station Case No. 06 of 2020. It is made clear that at the time of furnishing bail bonds, all the parties shall follow the guidelines regarding lockdown and social distancing.
