The petitioner apprehends his arrest in Hajipur SadarP.S. case No. 329 of 2017 for the offences punishable under Section 414, 406, 420/34 of the Indian Penal Code, under Section 7 of E.C. Act and under Section 4 and 5 of Prevention of Black Marketing and Maintenance of Supply of Essential Commodities Act.

The learned counsel for the petitioner submits that the Block Supply Officer lodged the case after recovery of 91 and 14 sacs filled with rice from the house of Gulabia Devi. It is submitted that Gulabia Devi disclosed the name of Bipin Kumar, Ravi Kumar, the petitioner, Ranjan Kumar, Arvind Kumar and

Patna High Court Cr.Misc. No.17541 of 2018 (2) dt.05-04-2018 2/2 Kullu Sah that they had kept the rice in her shop. It is submitted that Bipin Kumar, Ranjan and Arvind Kumar have already been granted anticipatory bail vide order passed in Cr. Misc. No. 62296 of 2017 and Cr. Misc. No. 7351 of 2018 and the case of petitioner stands on same footing.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S. case No. 329 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
