JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-09-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor representing the State of Bihar. This application, for grant of anticipatory bail, arises out of Narari Kala Khurd Police Station Case No. 23 of 2017, disclosing offences under Sections 341/323/506/325/307/34 of the Indian Penal Code.

Referring to the First Information Report, learned Counsel for the petitioners has submitted that land dispute between the parties is the only cause for registration of the present First Information Report. She has submitted that the allegations are vague and omnibus and the injuries have been

Considering the above submissions, this application is allowed.

Let the petitioners, namely, Sunil Paswan, Anil Paswan, Sikandar Paswan and Chhotu Paswan, in the event of their arrest or surrender before the Court below within a period of six weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Narari Kala Khurd Police Station Case No. 23 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure, 1973.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court below on two consecutive occasions, their bail bonds shall be liable to be cancelled.
