JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-04-2019 The petitioner apprehends his arrest in connection with Sonbarsa P.S.Case No. 24 of 2019 registered under Sections 272 and 230 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act.

Allegation is of recovery of 352 litres of foreign liquor from Bhusa Ghar of the petitioner.

Submission of learned counsel for the petitioner is that it's an open house and the same was kept by other co-accused persons and petitioner has no criminal antecedent. Heard learned APP also who has opposed the prayer for anticipatory bail of the petitioner on the ground of recovery of huge quantity of liquor from the house of the petitioner. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant

Patna High Court CR. MISC. No.22279 of 2019(2) dt.08-04-2019 2/2 privilege of anticipatory bail to him rather he should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order.
