JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Digha P.S. Case No. 384 of 2015 registered under Sections-325, 307 & other minor sections of the Indian Penal Code. Petitioner is said to have dashed the vehicle of informant by using iron chain and except the aforesaid allegation, there is nothing against the petitioner. Moreover, having more or less similar allegation, one co-accused Kamlesh Kumar and one other have already been granted privilege of anticipatory bail by a coordinate bench of this court. The petitioner does not have any criminal antecedent.

Accordingly, this anticipatory bail petition is

Patna High Court Cr.Misc. No.45136 of 2016 (2) dt.22-12-2016 2/2 allowed and it is ordered that the petitioner named above, in the event of his arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Digha P.S. Case No. 384 of 2015 to the satisfaction of Md. Imam Khan, learned Judicial Magistrate-Ist Class, Patna subject to condition as laid down u/S 438(2) of the Code of Criminal Procedure Code.
