The petitioner apprehends his arrest in a case registered for offences punishable under Sections 147, 148, 323, 379, 307, 504, 506 and 34 of the Indian Penal Code.

It is contended that there is dispute between the parties and title suit has also been instituted by the informant against the father of the petitioner as well as his sister. Though it is alleged in the F.I.R. that petitioner had assaulted by knife causing injury on the head, however, injury report shows lacerated wound which is simple in nature caused by hard and blunt substance which does not support the allegation of assault upon the petitioner.

Hasnain Khan be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Bathnaha P.S. Case No. 73/16, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
