JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 13-09-2017 This matter has been taken up for hearing out of turn on the prayer of the learned counsel for the petitioner. The present application has been filed for modification of order dated 25.01.2016 passed in Cr. Misc. No. 2766 of 2016 to the extent of extending the period of surrender. The petitioner was granted anticipatory bail vide order dated 25.01.2016 passed in Cr. Misc. No. 2766 of 2016 in a case registered for the offences punishable under Sections 419, 420, 467 and 468/34 of the Indian Penal Code with condition to surrender and furnish the bail bond within a period of twelve weeks.

Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.43080 of 2017 (2) dt.13-09-2017 2/2 the petitioner could not surrender since she was carrying pregnancy.

Considering the grounds taken in the modification application, the order dated 25.01.2016 passed in Cr. Misc. No. 2766 of 2016 is modified with regard to the petitioner to the extent that the period of surrender is extended by three weeks from the date of receipt/production of a copy of this order in connection with Laheriasarai P.S. Case No. 136 of 2013, pending in the court of learned Chief Judicial Magistrate, Darbhanga.

Accordingly, this modification application is disposed of.
