JUSTICE SUDHIR SINGH ORAL ORDER 12-07-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 420 and 406/34 of the Indian Penal Code and later on, Sections 3 / 4 of the Dowry Prohibition Act have been added.
Allegation against the petitioners is that they took Rs.7 lacs from the informant but refused to get married with the sister of the informant.
It is submitted on behalf of the petitioners that they have got no criminal antecedent. They have falsely been implicated in the present case. The allegation made in the F.I.R has been denied by the petitioners. Petitioner no. 1 is an employee in the C.I.S.F. It is further submitted that petitioners are ready to deposit an amount of Rs.1 lac in the court below which shall be subject to the final disposal of the case.
On behalf of the State and the informant, it is submitted that petitioners are named in the F.I.R. and they have committed fraud by giving a false assurance in respect to the marriage to be performed with the sister of the informant.

No.27199 of 2016 (2) dt.12-07-2016 2/2 Considering the aforesaid facts and circumstances, petitioners are directed to deposit an amount of Rs.1 lac in the court below which shall be subject to the final disposal of the case. Let the above named petitioners, in the event of their arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, Patna. in connection with Barh P.S. Case no. 86 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
