The petitioner apprehends arrest in connection with Bhairav Asthan P.S. Case No. 21 of 2017 registered under Sections 272, 273, 290 of the Indian Penal Code and 30(a), 38(1)(2) of the Bihar Excise Prohibition Amendment Act. Learned counsel appearing on behalf of the petitioner submits that there is no material in the case diary against the petitioner. On perusal of seizure list, it appears that nothing has been recovered from the possession of the petitioner, rather the alleged material has been recovered from the godown of the PACCS.

No.38583 of 2017 (4) dt.18-10-2017 2/2 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-II, Madhubani/In-charge Successor Court in connection with Bhairav Asthan P.S. Case No. 21 of 2017/G.R. No. 453 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
