The petitioner apprehends his arrest in Goh P.S. Case No. 145/2016, registered for the offences punishable under Sections 420, 408 of the Indian Penal Code and section 4 of the Prevention of Money Laundering Act.

The Circle Officer, Goh alleged that he got information that the petitioner is Panchayat Secretary of Chapuk Panchayat distributed notes of Rs. 500/- and Rs. 1000/- denomination to the beneficiaries of the old age pension after promulgation of demonetization.

Mr. Bachan Jee Ojha learned counsel for the petitioner submits that petitioner distributed the money on 15.11.2016. Six beneficiaries were given Rs. 2400/- each as their

Patna High Court Cr.Misc. No.17373 of 2017 (3) dt.05-07-2017 2/2 pension. Meager amount was distributed.

Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that only amount of Rs. 15,000/- was distributed among the pensioners, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Goh P.S. Case No. 145/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
