The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

The prosecution case is that Md. Shafique Ansari was robbed by 15-20 miscreants, leading to registration of First Information Report against unknown on 06.10.2002. During investigation the name of the petitioner sprang up and consequently the petitioner was charge-sheeted vide Charge-sheet No. 34 of 2003 on 06.02.203 under Section 395 of the Indian Penal Code, but the petitioner did not appear.

Considering the nature of accusation and the fact that investigation has already concluded, this

Patna High Court Cr.Misc. No.35712 of 2016 (2) dt.02-09-2016 Court is not inclined to grant anticipatory bail to the petitioner in connection with Sadar P.S. Case No. 300 of 2002, pending in the court of learned Chief Judicial Magistrate, Purnea. Accordingly, the anticipatory bail application is dismissed.
