====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 15-04-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 01.02.2019 in a case for the offence registered under Section 379 of the IPC.

The prosecution story, in brief, is that when the informant was travelling on 17.09.2018 with her family on Train No. 15707 Up Amarapali Express from Katihar to Ludhiana and during that course on 18.09.2018 at about 4.30 A.M. when Train was started from Barauni Station then her bag containing documents, money, ornaments, Aadhar Card, Voter Card, one Corporation Bank A.T.M. Card on which secret code is written,

The informant has full confidence that some unknown thief committed theft of her bag. It has been submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. The petitioner is not named in the F.I.R. His name has come in course of investigation. There is no recovery of stolen article from possession of the petitioner. It is further submitted that the petitioner is ready to deposit an amount of Rs. 20,000/- (Rupees Twenty Thousand) only in the learned court below which will be subject to final disposal of the case. On behalf of the learned counsel for the State, it has been submitted that the petitioner is not named in the F.I.R/ complaint case.

Considering the aforesaid facts and circumstances, the petitioner is directed to deposit Rs. 20,000/- (Rupees Twenty Thousand) only in the learned court below which will be subject to final disposal of the case. On doing so, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.,
