JUSTICE BIRENDRA KUMAR ORAL ORDER 28-10-2021 Heard learned counsel for the petitioner, informant and learned Additional Public Prosecutor for the State. The petitioner is languishing in custody for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

12 persons named in the FIR including the petitioner allegedly fired at Heman Yadav @ Vikash Kumar as a result whereof he died. The doctor has found several fire-arm injuries on the person of the deceased.

Submission is that the petitioner has got no criminal antecedent. No motive has been alleged against the petitioner or anyone. The petitioner is in custody since 03.12.2020. Investigation of the case is already complete.

Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on bail in connection with Sheikhopur Sarai P.S. Case No.99 of 2020. Hence, prayer for bail is refused. The trial-court is directed to expedite the trial.
