The petitioner seeks bail in Riga P.S. Case No. 246 of 2018, instituted for the offence under Section(s) 379 of Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. Petitioner has been arrested by the Police in Riga P.S. Case No. 292 of 2018 and thereafter, he has been remanded in the instant case merely on suspicion. He further submits that other co-accused have already been granted bail by this Court as well as coordinate Bench of this Court vide orders dated 3.4.2019 and 11.4.2019 passed in Cr. Misc. 20562 of 2019 and 21857 of 2019 respectively.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Riga P.S. Case No. 246 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
