JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-09-2020 In view of the submission and undertaking of the learned counsel for the petitioners, at the time of hearing of this application through Video Conferencing, that he would remove the defect(s), as pointed out by the stamp reporter, within two weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.

Heard learned counsel for the petitioner and the learned APP appearing for the State through Video Conferencing.

The petitioner apprehends his arrest in connection with Panepur P.S. Case No. 20 of 2020, registered under Sections 363 and 366(A)/34 of the Indian Penal Code.

No.22199 of 2020(2) dt.18-09-2020 2/3 The accusation is that minor daughter of the informant, Suraj Pandit, moved from her house in the morning of 06.02.2020 to attend the coaching class but she did not return till evening. In course of search, informant came to know that petitioner kidnapped his minor daughter with bad intention with the help of Munna Sah and Dinesh Sah.

Learned counsel for the petitioner submits that, in fact, due to love affairs, Nibha Kumari, daughter of the informant, left her house and went to Delhi and performed the marriage with the petitioner according to her own sweet will, which would appear from her statement recorded under Section 164 of the Cr.P.C. (Annexure 2 of the Bail Petition) but due to ulterior motive, the present case has been lodged with false allegation.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Saran, Chapra, in connection with Panepur P.S. Case No. 20 of 2020, subject to the condition as
