The present application has been filed for modification of the order dated 2.2.2017 passed in Cr. Misc. No. 30073 of 2016, to the extent of modifying the quantum of undertaken monthly payment. The petitioner, being the husband of the complainant, was granted provisional anticipatory bail vide order dated 2.2.2017 passed in Cr. Misc. No. 30073 of 2016 on the submission that the petitioner is ready to make payment of Rs.4000/- per month to the complainant from March, 2017.

In the present modification application, vide order dated 3.7.2019, notices were issued to O.P. No. 2 but due to non-compliance of the peremptory order, this application stood dismissed as against O.P. No. 2. Since the State of Bihar is a
