The petitioner apprehends his arrest in Jakkanpur P.S.Case No.184 of 2017 corresponding to G.R.No.3965 of 2017 registered under Sections 274, 275, 276, 419, 420, 467, 468, 120(B) of the Indian Penal Code and Section 27 (d)/ 28(A) of Drugs and Cosmetic (Amendment) Act,2008.

The Drug Inspector had inspected a vehicle in which different drugs were being carried by Mukesh Kumar Gupta which he had purchased from different medicine shops including the petitioner.

Learned counsel for the petitioner submits that for the same occurrence Pirbahore P.S.Case No.320 2017 was also registered against the petitioner under the same sections of the

Patna High Court Cr.Misc. No.17852 of 2018 (2) dt.05-04-2018 2/2 I.P.C. and the Drugs and cosmetics Act. The petitioner has already been granted anticipatory bail in Pirbahore P.S.Case No.320 of 2017. The allegation against the petitioner is that he sold the drugs without receipts. It is further submitted that the police is not competent authority to register F.I.R.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M.,Patna, in Jakkanpur P.S.Case No.184 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
