This application has been filed for quashing the order dated 10.02.2023 passed by learned SDJM, Gopalganj in Sessions Trial No. 1980 of 2022 arising out of Gopalganj Mahila P.S. Case No. 14 of 2019 whereby the bail bond of the petitioner has been cancelled and non-bailable warrant has been issued against him.
The petitioner had given a petition on affidavit in the Court below that he wants to settle the dispute by paying Rs. 25,00,000/- to the O.P. No. 02.
Learned senior counsel for the O.P. No. 02 submits that the O.P. No. 02 is also ready for the settlement but no
Patna High Court CR. MISC. No.25025 of 2023(2) dt.15-05-2023 2/2 payment has been made to her.
It seems that the petitioner is taking this Court to a ride and is trying to mislead this Court, as once the petitioner had given an petition on affidavit that he is ready to settle the dispute after paying Rs. 25,00,000/- then the petitioner should have done this long back.
Considering the above submissions of the parties and upon perusal of the impugned order, this Court is of the view that there is no illegality in the impugned order and these kind of petitioners do not deserve any sympathy from the Court. Accordingly, this application is dismissed.
