2. The petitioner seeks bail in connection with Katihar Nagar P.S. Case No. 494 of 2024 dated 21.07.2024, instituted for the offence punishable under Sections 109, 118(1), 118(2), 351(1), 351(2), 351(3), 103(1) of the B.N.S., 2023.

3. The allegation against the petitioner is that he assaulted his wife (informant) with repeated blows of a knife, due to which she succumbed to injuries and subsequently, died during course of treatment.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that petitioner is the husband of the deceased (informant) having three children aged between 8 to

It is next submitted that police has not examined any local witness, the two witnesses are hearsay witnesses as one of them namely, Priyanka Devi lives about 3 km from the place of occurrence and the second one namely, Pushpa Devi lives about 4 km from the place of occurrence. Lastly, it has been submitted that the petitioner is in custody since 21.07.2024 having no criminal antecedents and charge-sheet has been submitted in the case.

5. Learned A.P.P. vehemently opposed the prayer for bail of the petitioner and submitted that the petitioner is the husband of deceased (informant) and sole accused in this case. There is a specific allegation of repeated blows by knife on the body of informant due to which she died during course of treatment.

6. Earlier, a report about the stage of trial was called for from the concerned court which has been received and it reveals that one witness has been examined. The main eye witness namely, Priyanka Devi is yet to be examined.

7. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, I am not inclined to grant bail to the petitioner at this stage.

8. Accordingly, the prayer of the petitioner for bail is

9. However, the learned Trial Court is directed to expedite the trial and take all endeavour to conclude the trial at the earliest, preferably, within a period of nine (09) months from the date of receipt or production of a copy of this order. (Khatim Reza, J) Sankalp/- U T
