By the impugned order, the learned court below has rejected the petition filed by the petitioner questioning the earlier Vakalatnama and written statement filed by the predecessor of the petitioner on the ground of fraud and forgery. Learned court below has found that the petition challenging the Vakalatnama and written statement in question on the
Patna High Court CWJC No.13090 of 2014 dt.19-09-2016 ground of fraud and forgery has neither been on affidavit nor has been verified and on that basis the learned court below has refused to entertain the same. This Court is, therefore, not inclined to interfere with the impugned order under Article 227 of the Constitution of India.
The application is, accordingly, dismissed.
The dismissal of this application, however, shall not preclude the petitioner from seeking redressal of his grievances in accordance with law.
