2. Petitioner seeks regular bail in connection with Kadirganj P.S. Case No. 19 of 2025 in a case registered for the offences punishable under Sections 30(a),(d) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, 15 litres illicit country made liquor and some apparatus used in manufacturing of liquor were recovered from the bank of Sakri river.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case merely on the basis of suspicion. Nothing was recovered from the conscious possession of the petitioner, rather recovery was made from an open place which is accessible to all. Petitioner is in

Patna High Court CR. MISC. No.24598 of 2025(3) dt.16-05-2025 2/2 custody since 11.03.2025. Chargesheet has been submitted.

5. Learned A.P.P. for the State vehemently opposes the bail application and submits that petitioner carries three criminal antecedents of similar nature.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court-I, Nawada, in connection with Kadirganj P.S. Case No. 19 of 2025.
