The petitioners apprehend arrest in a case registered for

Patna High Court Cr.Misc. No.31207 of 2016 (2) dt.09-08-2016 2/3 offences punishable under Sections 147, 148, 149, 323, 324, 332, 333, 307, 379, 427 and 504 of the Indian Penal Code and Sections 53(b), 61, 64 of the Bihar Excise Amendment Act, 2016.

First Information Report has been lodged against 12 named and 100 - 140 unknown persons. As per allegation supporters of two candidates of Mukhia post started assaulting each other. When the police intervened and rescued two persons, namely, Awadhesh Mishra and Pawan Mishra, crowd attacked on the police party also causing injury on the informant as he got scalp deep injury in side of occipital region. It is contended that the allegations are general and omnibus in nature and it is nowhere stated that petitioners have specifically assaulted upon the police personnel.

Having regard to the facts and circumstances of the case, let the petitioners, namely, Dharmdev Das, Kamal Das, Vimal Das, Ramrati Das, Pawan Das, Paran Das, Sarath Das, Anil Das, Ajay Das, Pankaj Das and Basudev Das be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Kahalgaon P.S. Case No. 142/2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) each with two sureties of

Patna High Court Cr.Misc. No.31207 of 2016 (2) dt.09-08-2016 3/3 the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
