The petitioners are seeking anticipatory bail in connection with Agamkuan P.S. Case No. 715/2018 registered under Sections 498(A), 504, 506/34 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act, pending in the court of learned A.C.J.M. - I, Patna City, Patna.

Order-sheet of this case shows that earlier the petitioners were granted privilege of provisional anticipatory bail by a learned coordinate Bench of this court vide order dated 12.04.2019. Thereafter, when the matter was listed on

Patna High Court CR. MISC. No.23163 of 2019(4) dt.22-07-2019 2/3 13.06.2019, none appeared on behalf of the petitioner. Today, once again no one has appeared. This court is however not willing to adjourn the matter and deems it just and proper to dispose it of on the basis of the materials available on the record.

It appears that petitioner no. 1 is the elder brother of the husband of opposite party no. 2. The opposite party no. 2 was earlier noticed by this court but she has chosen not to enter appearance in this case. Petitioner no. 1 is the elder brother whereas petitioner no. 2 is younger brother of the husband of opposite party no. 2. There are allegations that immediately after the marriage in the year 2017 the husband of opposite party no. 2 and his family members were demanding dowry of Rs. 5,00,000/- and they were also indulging in beating of the informant. In the F.I.R. she has made specific allegation against her husband that on 19.09.2018 he had assaulted her and had taken her signature on a blank-sheet of paper. So far as these petitioners are concerned, there is no specific allegation against these petitioners. Earlier they have been granted privilege of provisional anticipatory bail by learned coordinate Bench of this court and this court thinks it just and proper to confirm the provisional anticipatory bail.
