This application for regular bail arises out of Bhagwanpur P.S. Case No. 247 of 2019, disclosing offences punishable under Section 379 of the Indian Penal Code. The allegation relates to theft of the informant's motorcycle by unknown miscreants. In course of investigation, the petitioner's name transpired on the basis of confessional statement of co-accused and the stolen motorcycle was recovered from his possession.

Learned counsel for the petitioner has submitted that in similar circumstance, co-accused Saurabh Kumar has been allowed regular bail by this Court by order dated 25.02.2020 passed in Cr. Misc. No. 8237 of 2020. A copy of the said order

Patna High Court CR. MISC. No.22225 of 2020(2) dt.28-08-2020 2/2 has been brought on record by way of Annexure-2 to the application.

Considering the aforesaid submission and the fact that similarly circumstanced co-accused has been allowed regular bail, this application is allowed.

Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Vaishali at Hajipur in Bhagwanpur P.S. Case No. 247 of 2019.
