The petitioner apprehends his arrest in Ghanshyampur P.S. Case No.173/2017 registered under Section 414 of the Indian Penal Code and Section 7 of E.C. Act.

The informant intercepted two mini trucks. One bearing registration no.BR06TC47/10 and another bearing registration no.BR07GA-1618, loaded with rice.

Learned counsel for the petitioner submits that the petitioner is owner of mini truck bearing registration no.BR07GA1618. The driver of the truck was plying the truck on hire. The petitioner is not at all concern with the loaded rice. Considering the aforesaid fact and nature of allegation made against the petitioner and the fact that the petitioner is owner

No.17930 of 2018 (2) dt.06-04-2018 2/2 of the truck, the petitioner above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Darbhanga, in connection with Ghanshyampur P.S. Case No.173/2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
