2. It has been informed to this Court that during the pendency of the writ petition, the petitioner on being advised has preferred an appeal against the order, as contained in Memo No. 128 dated 31.07.2008, passed by the Managing Director, Bihar State Cooperative Land Development Bank Ltd., Patna

Patna High Court CWJC No.113 of 2009 dt.16-01-2024 2/2 whereby and whereunder the petitioner (appellant) has been inflicted with the punishment that half of the not recovered loan amount related to three loanee members (Tractor and other equipment's), which comes to Rs.12,86,264/-, as per calculation, loss caused to the Bank shall be realized from the petitioner.

3. It is submitted on behalf of learned counsel appearing on behalf of the respective parties that the aforenoted appeal is pending consideration before the Appellate Authority and the next date of hearing is scheduled to be fixed on 20.01.2024.

4.Considering the submissions advanced on behalf of the parties and the development, as has taken place, during the pendency of this case, the present writ petition stands disposed of with a liberty to the petitioner to pursue his appeal and in case of any adverse order, he shall be at liberty to approach before the appropriate forum/Court in accordance with law.
