The petitioners apprehend arrest in connection with Kasim Bazar P.S.Case No.103 of 2017 pending in the Court of CJM, Munger registered for an offence under the Arms Act. The case has been registered on the self statement of SHO of Kasim Bazar police station. The informant on getting confidential information conducted raid in one of the rooms of Indira Aawas Colony which was unauthorizedly occupied by the petitioners. It is said that the police party apprehended two persons from the place of occurrence. The room was searched and police recovered illegal wine as well as accessories meant for preparing fire arm. Accordingly, these petitioners were booked under the aforesaid Sections.
On perusal of annexures as well as order of
Patna High Court Cr.Misc. No.31148 of 2017 (2) dt.13-07-2017 2/2 Additional Sessions Judge, Munger, I find that a large number of witnesses have supported the allegation of running factory of preparing fire arms against the petitioners unauthorized in the Indira Aawas. They have stated that the rooms were in possession of these petitioners and they were indulged in the business of wine as well as manufacturing fire arm.
Considering the nature of the allegation, I am not inclined to grant anticipatory bail to the above named petitioners. The prayer of anticipatory bail is rejected.
