The petitioner seeks bail in Koran Sarai P.S. Case No.70 of 2019, registered under Section 392 of the Indian Penal Code.

The informant alleged that while the informant and others were returning to Grahak Seva Kendra from S.B.I. Branch, Koran Sarai with Rs.2,27,000/-, the miscreants on two motorcycles came and pushed the motorcycle of the informant from behind as a result of which the informant fell down and the miscreants took Rs.2,27,000/- and 2 mobiles from the pocket. Learned counsel for the petitioner submits that the petitioner is not named in the FIR. The name of the petitioner surfaced in the case in the confessional statement of Maksud

Patna High Court CR. MISC. No.25226 of 2020(2) dt.28-09-2020 2/2 Mansoori. Maksud Mansoori has already been enlarged on bail vide order dated 05.06.2020, passed in Cr. Misc. No.17953 of 2020. The petitioner is in jail since 21.02.2020, but the petitioner has not been put on TIP. The Investigating Officer has submitted charge sheet solely on the basis of the confessional statement of the co-accused which is made before the police and the same is not admissible. It may be helpful for the purpose of investigation. The petitioner is in jail for more than seven months.

Taking into consideration the facts aforesaid, petitioner, namely, Rinku Yadav @ Ripu Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st, Court No.5, Buxar in connection with Koran Sarai P.S.
