JUSTICE SANJAY PRIYA ORAL ORDER 15-01-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Vishnupad P.S. Case No. 63 of 2017 instituted for the offence under Section 420 of the Indian Penal Code.

It is alleged in the written report that this petitioner induced the informant and several depositors as mentioned in the written report to deposit money in particular company on the assurance that they would get double of the amount on maturity after two years, but on maturity, the money was not paid to the depositors and when they met them, they told that the company has fled away. It is alleged that this petitioner has cheated the amount of Rs.5,87,700/- from several depositors as mentioned in detail in the written report. The informant was induced to deposit

Patna High Court Cr.Misc. No.44819 of 2017 (5) dt.15-01-2018 2/2 a sum of Rs.2,31,000/-.

The informant has alleged that this petitioner has got his house constructed from the aforesaid amount and is also doing business, but he is not returning the amount in question. Considering the facts and circumstance of the case, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail which shall be considered/disposed off by the court below in accordance with law without being prejudiced by this order.
