This appeal is preferred against the order dated 24.03.2025 passed by the learned Exclusive Special Judge, S.C./S.T., Saran at Chapra, in connection with Saran S.C./S.T. P.S. Case No.24 of 2024 registered for the offence under sections 127(2), 115(2), 352 and 3(5) of the B.N.S., 2023 and under sections 3(1)(r)(s) of the S.C./S.T. Act, by which the

Patna High Court CR. APP (SJ) No.1398 of 2025(6) dt.25-11-2025 2/3 prayer of the appellants for grant of anticipatory bail has been rejected.

As per the F.I.R., while the informant was working in the field, the appellants came at the field and abused her by saying her caste name. When the informant protested, she was assaulted by the appellants.

Learned counsel for the appellants submits that the appellants have clean antecedent and they have been falsely implicated in this case due to a dispute over working in the land as a labourer.

Learned Special Public Prosecutor for the State and learned counsel for the informant opposed the prayer of the appellant for grant of bail.

I have considered the submissions of the parties.

Considering the fact that the incident has taken place on account of a trivial dispute, this appeal is allowed. Accordingly, the impugned order dated 24.03.2025 is set aside.

Let the appellants, in the event of their arrest or surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/-(Rupees Ten Thousand)
